- Agreement to Build
- Perth Patio Magic (PPM) agrees to build and complete for the Client the patio(s) drawn in the quotation
‘Works’), in accordance with the terms andconditions of this Contract, inclusive of all Standard Specifications and agreed between the parties for the Contract Price.
- Where there is a difference or inconsistency between the Contract Documents, they will be constructed in the following order of price difference; any specialconditions, Contract to Build, Standard Specifications, Quotation drawing.
- Whilst every effort is made to ensure that accurate pricing and descriptions are maintained, we reserve the right to decline orders if they are based on inaccurateinformation or errors made by either party.
- Perth Patio Magic (PPM) agrees to build and complete for the Client the patio(s) drawn in the quotation
- Contract Price
The price for the Works shall be the amount detailed on the accompanying documents, which shall be subject to the adjustments and variations provided for in this Contract.
- Subject to the payment terms accompanying this Contract, the Contract Price shall be paid as follows:
- Deposit payment of six point five percent (6.5%) is required before any work to prepare plans to Shire will commence.
- Materials Instalment Payment of forty eight point five percent (48.5%) is required before any materials are ordered or any fabrication for the Client’s patio will commence.
(ii) Completion Payment of thirty five percent (35%) is to be made once the patio has reached practical completion.
- The price for the Works will remain valid for 30 days from the date of Contract signing. If the works are not started within this period of time due to delay causedby the Client, the Contract becomes void and any costs incurred up to that point will be taken from the monies paid.
- If the Client does not pay any amount owing to PPM by the due date for payment:
- The Client must pay interest for late payment at the rate of fifteen per cent (1596) per annum; calculated daily; andPPM may suspend the works until payment is received in tuft.
- Only a first and final account will be issued. If the Client fails to pay any monies under this Contract they will be liable for any legal, debt collection, or othercosts PPM may incur in seeking payment of these monies.
- If the Client does not pay any amount owing to PPM by the due date for payment:
- Security
The Client hereby charges the Iand constituting the Site with the due payments to PPM of all monies that will be may become payable hereunder and irrevocably authorizes and consents to PPM lodging a subject to claim caveat in respect of the Site to protect PPM interests herein.
- Building License
- PPM will apply for the building licence for the patio works if indicated on the quotation. If the quotation indicates Client will obtain then the Client hereby agreesthat they will obtain an accurate building licence for the Works and the Client has agreed PPM will perform the patio works as approved.
- Should the patio desk be rejected by the local shire council and the Client wishes to cancel the patio as a result, PPM will refund the Clients deposit, minus the costs and fees involved in submitting the building licence application. However, if the Client has paid the Materials Installation Payment of forty eight point five percent (48.5%) and PPM have proceeded to order materials then no refund will be given.
- The Client agrees that should their shire council require a bond payment or any other fees prior to granting a Building Permit, the client ’will ’ make thispayment either to PPM or to the shire directly. The Client agrees that PPM is not responsible for the payment of auxiliary shire requirements.
- Variations
- Absolutely NO CHANGES to the Contract are permitted once the Materials Instalment Payment has been made. Upon receipt of this payment, the Client authorises PPM to commence ordering and fabricating materials. The Client accepts the risks involved in progressing this way before the Shire has approvedthe patio structure(s).
- If the Client wishes to make any variation to the Works of the Contract Documents, the Client or the Client’s agent shall give PPM a written request for such variation. PPM may decline to agree to the variation requested but in the event that PPM is prepared to agree to the variation:
- PPM shąll prepare and give to the Client or the Client’s agent a variation document setting out the terms of, and the cost to
be incurred on account of the variation;
(ii) The Client or the Client’s agent shall sign 8and return the variation document to PPM;
(iii) PPM shall sign and insert into the variation document the date on which the document was signed and forward a scanned copy to the Client or theClient‘s agent as soon as reasonably practicable thereafter and before the work to which the variation relates
is commenced; and
(iu) The variation shall be carried out as if it were part of the Works under the Contract.
- Defect Liability Period
- Subject to clause 6(b), as soon as is reasonably practicable, PPM shall make good, at the cost of PPM, any defects in the Works, provided thatPPM has been notified in writing within a two (2) year period from ‘Practical Completion!
- In clause 6(a), defect means failure to:
- Perform the Works in a proper and workmanlike manner and in accordance with this Contract; or
(il) Supply materials that are of merchantable quality and reasonably fit for the purpose for which the Client required the Works to be performed, excluding afailure for which PPM is specifically declared by this Contract to not be liable.
(c ) PPM shall not be liable to remedy any damage or rectify any defects to the works arising from any work carried out on site by the Client or the Client’s agents or servants at any time.
Steel
All Steel used is Australian made electroplated zinc steel. All Steel is powder coated in the colour stated on the quotation. Steel includes all trusses, rafters, purlins and posts unless otherwise stated. All steel is cut onsite to exact sizing with abrasive cutting discs. Cut ends of the material self cure once oxidising has occurred. Any markings from a cut end are normal and the oxidising process does not continue or negatively affect the material that has been cut Steel warranties are as per the manufacturer.Regular three (3) monthly cleaning of the steel is required to maintain your patio and prevent corrosion. Patios located within 1kmto the coast have no warranty period.
Trusses
All trusses are fully welded to exact sizing stated on the quotation. All trusses are zinc primed and powder coated to the colour stated on the quotation. All trusses will be made in the range of 20 — 25 degrees, which is best suited to the patio size unless theexact angle is stipulated on the quotation, or in the special conditions. Trusses will be made out of 76x38mm steel as standard. The size of steel used may need to vary between trusses to accommodate different truss designs. You, the Client, accept the trussdesign used by PPM, which will be in line with PPM engineering specifications.
Engineering
PPM beams, trusses and posts are all engineered and certified for each individual patio that we build. These specifications are stated and required
in our application to council for a building licence. All PPM Patios will be built in line with our engineering design limitations. Standard patio tube is 76mm x 38mm Rectangular Hollow Section. Larger beams will be used if stated and/ or are necessary.Beams indicated on your quotation will be overridden with the most suitable beam to perform the required function if they areindicated incorrectly on the quotation. Patios are not high tolerance engineered items.
This means that specifications and tolerances can vary up to 10mm and
still be of a very acceptable standard and aesthetically pleasing. The owner accepts the patio is engineered for fitting single skin roof sheeting only.
If the owner wishes to add lining materials such as timber or gyprock, they do so at their own risk. Metal beams used in the patiohave a deflection limit of span/200. Therefore a ‘sag’ or deflection in all steel beams is normal and accepted by the Client.
Posts
All posts are concreted into the ground as a standard. Posts can be fitted to an existing footing or concrete slab if it is in the correctspot and is deemed structurally suitable to use masonry fixing bolts. If the footing or concrete slab is unsuitable, it will need to beremoved and/or cut out to prepare a hole for a post that will be concreted in. Any extra digging or machinery needed to perform this or remove other items under the building level will be at the Client‘s expense and is not included in the quotation unless stated.PPM are not responsible for the repair or refit of paving and/or floor level materials such as liquid limestone disturbed to locate a post.
Gutters
AII PPM Patios will have independent guttering to any existing house or structure unless otherwise indicated on your quotation.Unless otherwise stated, all gutters used will be square cut patio gutters with 115mm base,
and 115mm side. All gutters will be made from BlueScope Steel in the colour stated in the quotation. Non-standard colours will be powder coated upon zinc gutters. Box guttering is the removal of an existing house gutter to be replaced with a larger box gutter toaccommodate the house water and new patio water. These will only be installed if detailed on the quotation. If you have a reed tohave a box gutter fitted to your patio, then you agree to the number of downpipes that are presently existing on your house areadequate for the extra water that the new patio will add. All patios that connect to a house will be built at the level of that house. If the fascia/eaves of the house are not level, the patio may also not be level and ponding of water may occur. The client accepts that should ponding occur, PPM will not be liable
for its repair or maintenance. PPM is not liable and will not be responsible for any existing house gutter problems. If you haveagreed for PPM to run water from our patios into your existing house gutters, then PPM will not be liable for any leaks, overflows or issues with this gutter. You agree that the gutters and downpipes existing are suitable and capable of performing with this extrawater. In large storm events there may be an overflow of our patio gutters. They are designed to overflow on the low side and prevent any water entering into your home in accordance with the latest Building Code of Australia (BCA). Patios are class 10a buildings according to the BCA and hence are not habitable buildings. Our patios are hence not waterproof
structures and should not be classed as so. Therefore it is possible that water spray overflow or condensation leaking can occur and is deemed a non- warrantable situation.
Downpipes
Downpipes will be 95mm x 45mm and in the same colour as the guttering unless otherwise stated. Downpipes will be installed where necessary
and appropriate if not detailed on the quotation. Unless detailed on the quotation, you the Client, accept the position chosen for thedownpipe(s) by PPM. The number of downpipes installed will be in line with the latest BCA. No downpipes will be installed on thyhouse side of a patio that is attached to a house unless detailed in the quotation. Downpipes will only be located on new posts installed for the patio unless otherwise stated on the quotation. Downpipes are fitted to ground level only and do not include subsoil drainage, connection or fitting.
Sheeting
Sheeting will be BlueScope Steel Colorbond 0.42BMT in corrugated or monoclad profile. The colour of sheeting will be on one side only unless clearly indicated ‘double side sheeting’ on your quotation. Double sided sheeting is only available in selectcolours and extra costs are applicable. Sheeting will be installed in line with the manufacturer’s recommendations and the currentBCA. Polycarbonate sheeting is not included unless clearly indicated on the quotation, the number and location of these sheets.
Endfills
These are not a standard item and are only included in your patio if indicated on your quotation. These are placed on the ends of trusses and can be Colorbond, polycarbonate or plastic lattice. Endfills will always run horizontal unless otherwise stated. Endfills willbe corrugated in profile if the roof sheets are corrugated. Endfills will be greca in profile if the roof sheets are Trimdeck.
Fascia Repairs
Our patio does not include any repairs to an existing fascia or connection point unless specifically stipulated in the Contract. If weare contracted to pull down and remove and existing patio, the Client accepts the house fascia and/or connection points as they arewhen the pull down is complete.
Flat Patios
Flat patios require a fall to allow water to run off. This fall is dependent on the roof sheeting used and will be a minimum of two (2)degrees. The rafters and sheets on a flat patio will start under the existing house gutter unless otherwise stated on the quotation.You, the Client, accept the finished height of the flat patio that is required to achieve an adequate fall.
Paint
Zinc rich primer and powder coat touch up paint will be applied to cut ends of steel and any imperfections, which may occur duringmanufacture or transport as per Orrcon/Onesteel/Onesteel Zinc rich primer and powder coat touch up paint will be applied to cut endsof steel and any imperfections, which may occur during manufacture or transport as per Orrcon/Onesteel recommendations.Screws in the framework will be painted if possible (where the risk of overspray is minimal). It is likely that during the transport ofyour patio materials, small markings may occur. These are not deemed a warrantable item. Touch up paint is used on the larger ofmarkings and is an acceptable method of repairing larger markings. Powder coat blemishes and surface deterioration mayoccur due to environmental conditions. Powder coating is an industrial process and the finish cannot be compared to that of amotor vehicle. It will not hale the same gloss levels and will be subject to minor irregularities. These will not affect the aestheticappearance or useful life of the product.
Pull Down and Removal
Pull down and removal fee does not include any electrical work such as removal, disconnections or refitting. It is the Client’s responsibility to have any electronic work disconnected by a qualified electrician before the pull down and removal can occur. PPM will not, under any circumstances, attempt to remove or refit any electrical items to or from a patio.
Care and Responsibility Extreme care will be taken on site by our installers however no responsibility can be taken for minor damage to items in the surrounding area.
